Administrative penalty for the employer failing to prevent discrimination in the workplace

Abstract: Article 19 of the Protection against discrimination act holds the employer liable for discrimination acts committed by its employee in the workplace. This is a typical case of vicarious liability for failure to prevent the wrongdoing of another person. This paper deals with the administrative penalty imposed by article 80, para. 3 of the Act on the manager of the legal entity – employer for failure to prevent an act of discrimination committed by an employee against another employee. A number of de lege ferenda proposals are advanced for developing the law in this area with a view to achieve effective compliance of the antidiscrimination law and the purpose of the administrative penalty regime.
