Abstract: Резюме: В настоящото изложение се предлага доктринално тълкуване на разпоредбата на чл. 333, ал. 4 от Кодекса на труда и въз основа на това се дава и отговор на поставените по тълкувателното дело № 4 от 2013 г. на ОСГК на Върховния касационен съд материалноправни въпроси. Разглежда се и съдебната практика на Върховния касационен съд, постановена през годините, в която се обсъждат различни аспекти по прилагането на чл. 333, ал. 4 от Кодекса на труда.
