Sectoral laws and the Sectoral Regulation System in Bolivia

Gover Barja Daza

MPRA Paper from University Library of Munich, Germany

Abstract: Abstract (English) This paper provides a comprehensive technical and structural analysis of the Sectoral Regulation System (SIRESE) and its regulatory contracts in Bolivia during the second wave of market-oriented reforms. It examines the transitional framework that replaced state-owned infrastructure with private provision, capital injection, and regulatory oversight across five key sectors: electricity, hydrocarbons, telecommunications, transport, and water sanitation. Using an industrial organization and principal-agent framework, the author details the fundamental mechanisms designed to simulate competitive market behavior, handle information asymmetries, and manage regulatory risk. The analysis evaluates core structural innovations introduced by the SIRESE Law, including vertical unbundling, anti-monopoly protections, dispute settlement paths, consumer complaint offices (ODECO), and independent performance auditing. Finally, the text highlights the institutional challenges, lack of sectoral legislation in specific fields, and political interference that constrained the system's consolidation.
