On the problem about the legal status of the Municipal Council

Abstract: Резюме: Статията разглежда въпроса дали Общинският съвет е субект на публичното право. За целта са посочени признаците субектите в правото и са съпоставени термините “субект”, “социална даденост” и “колектив”. От изложените аргументи се прави изводът, че Общинският съвет е орган на държавата и в частност на общината, а субект на правото е самата община.
