A Constitutional Court for Greece - An Institutional Shock in State of Coma

Abstract: Δεδομένου ότι στην χώρα μας ο δικαστικός έλεγχος συνταγματικότητας ακολουθεί το πρότυπο του διάχυτου ελέγχου, ανακύπτει εν προκειμένω το ζήτημα, εάν μια ρήξη στη θεσμική συνέχεια της πολιτείας μας δια της ίδρυσης Συνταγματικού Δικαστηρίου και δια της ως εκ τούτου μετάβασης από το σύστημα του διάχυτου στο σύστημα του συγκεντρωτικού ελέγχου, το οποίο καθιδρύει μονοπώλιο εκφοράς συνταγματικής κρίσης σε ένα ειδικό δικαιοδοτικό όργανο, συνιστά στην παρούσα χωροχρονική συγκυρία της πολιτείας μας ένα αναγκαίο και απαραίτητο θεσμικό μέτρο. Με άλλα λόγια κρίνεται σήμερα και υπό τις παρούσες συνθήκες απαραίτητο ένα θεσμικό σοκ στην ιστορική συνέχεια της πολιτείας μας δια της ίδρυσης Συνταγματικού Δικαστηρίου ; ------- Traditionally, constitutional control in the Hellenic Republic is performed by the courts which can review and declare the (un)constitutionality of legislative acts on a case-by-case basis. Of course, International Human Rights Law, enjoys a higher and special hierarchical order within the national legal system. The current survey examines whether, under the current institutional circumstances (e.g. fiscal crisis, political insecurity and institutional collapse), the Hellenic Republic is in need of an institutional shock by way of establishing a specialized Constitutional Court. To paraphrase Carl Schmitt, where would stand a Constitutional Court with the Hellenic Order and Emplacement (Ordnung und Ortung) ?
