Legal responsibility and control for observing labour and social insurance legislation

Abstract:
In recent years, in view of the democratic changes that have taken place in this country and our membership of the European Union, there have been set new requirements and challenges to national legislation. This is particularly significant in the sphere of control and application of the standards of employment and social security law, as well as with respect to the infringements that are possible and are connected with those. In that sense the study emphasizes the applied in the respective sphere legal responsibilities, competences, powers and acts of the controlling authorities. In section one there are given general theoretical formulations, concerning the principles of responsibility and control, examined in the light of the historical development, the comparative and international legal systems. In the following sections two and three the authors, in accordance with the specific legal branch, thoroughly and in detail analyze the current and topical problems of the types of responsibility, the nature, forms of control and the powers of controlling authorities. There are justified and drawn some practical problems of the application of legislation, some existing imperfections in the system, as are put forward specific suggestions de lege ferenda for improving the legislative framework.
