Abstract: يعرض الباحث إلى يد الأمانة ويد الضمان والفرق بينهما وبين الأحوال التي يمكن أن تنقلب فيها يد الأمانة إلى يد ضامنة، ويوضح حالات اشتراط الضمان على صاحب اليد الأمينة، ومتى يصح هذا الاشتراط ومتى لا يصح، ويستعرض من خلال ذلك آراء الفقهاء المعتمدين في المذاهب المختلفة ليصل في ختام بحثه إلى جواز اشتراط الضمان على الأمين وأنه صحيح وملزم شرعاً, لكنه يؤكد أن هذا الضمان ليس مطلقاً، بل يتناول أشياء محدودة.
