Abstract: يتناول البحث موضوعاً مهماً وقضية ذات شأن في الفقه الإسلامي وهي (العُرف) حيث تناوله الباحث من منشأه، فعرّفه اصطلاحاً وذكر أثر الاحتجاج به في الفقه، ثم بين أثره في المعاملات المالية ذاكراً أصوله فيها ، وذلك بالتركيز على معاملات التمليك في عقود المعاوضات، ثم عقود التبرعات من قرض وإعارة ووقف وهبة ووصية وغيرها من العقود التي تتبع في معاملات الشركات كعقد الإيداع .. إلخ.
