Abstract: 본 연구는 4차 산업혁명 시대 산업간 및 기술간 융·복합으로 인해 변화된 경쟁환경하에서 미국과 EU 경쟁당국의 특정 기업 및 기업집단에 의한 시장지배적지위 남용 및 기업결합에 대한 정책 대응을 비교ㆍ분석한다. 미국과 EU는 서로 다른 역사적 배경하에서 경쟁법 및 경쟁정책을 수립해 왔으며, 이와 같은 차이는 최근 디지털경제의 특징과 결합되어 양 경쟁당국 및 사법당국의 규제 차이를 발생시키고 있다. 이를 구체적으로 살펴보기 위해 미국과 EU 역내 ICT 산업에서 벌어지고 있는 디지털플랫폼 기업들의 대표적인 시장지배적지위 남용 및 기업결합 사례를 선정하고, 각 사례별로 미국과 EU의 정책 대응을 분석한다. 또한 기존의 경쟁정책 틀 안에서 디지털플랫폼 기업행위가 경쟁 및 소비자후생을 저해하는지 여부를 판단하는 것이 적절한지 알아보기 위해 디지털플랫폼 기업결합이 경쟁에 미치는 영향을 구조모형 추정을 통해 분석한다. 이러한 ICT 산업 내 기업행위에 대한 미국과 EU의 경쟁정책 집행사례와 실증분석 결과를 바탕으로 산업간 융·복합 시대 우리나라 실정에 맞는 경쟁정책 수립을 위한 시사점을 도출한다. This study aims to provide implications for policies on the part of Korea's competition authority to prevent ICT firms from abusing their market power and carrying out anti-competitive M&As under the changing competitive environment in the era of inter-industry convergence. It may be difficult to conclude whether these firm behaviors harm market competition or consumer welfare under existing competition policies. In this regard, we focus on recent policies of the U.S. and EU competition authorities in terms of how they deal with anti-competitive behaviors in ICT sectors. (the rest omitted.)
