La transformation de la méthode communautaire

Abstract: A study of European Union public policies from a pragmatic approach to law focusing on policymaking tools reveals that the community method is, in fact, currently in competition with new tools that, far from isolated initiatives, are profoundly transformative parts of an alternative model of European governance. This transformation of European policymaking relies on the abundance of new policymaking tools - more technical than political, and more incentivizing than restricting - that systematically imply collaboration between public and private players, and a disciplinary method that is increasingly "restraint by image", based on a model of "bad student in the classroom". These developments are additionally not without consequence in the dynamics of European lawmaking insofar as changes appear on the content level, as well as that of production and implementation.
