An International Investment Court: panacea or purgatory?

M. Sornarajah

No 180, Columbia FDI Perspectives from Columbia University, Columbia Center on Sustainable Investment (CCSI)

Abstract: EU officials have proposed the establishment of a permanent court for investment disputes. But there is no guarantee that bias, the reason for the lacking legitimacy of investment arbitration, does not affect judges. This Perspective suggests that it may be preferable for investment disputes to be settled by domestic courts.
