Abstract: -- الأستاذ الزرقاء ليس أستاذي فحسب، بل هو أستاذ أساتذتي، لكنني أستأذنه في التعقيب على اقتراحه، فإن كان حقًا فأرجو منه التأييد والتشجيع، وإن كان خطأ فاسأله التصحيح والتعليم. ويتلخص اقتراح الأستاذ الزرقاء في نص الحديث النبوي "لَيُّ الواجدِ يُحِلُّ عِرْضَه وعقوبته"، وقد نص الشُرَّاح على أن العقوبة هي الحبس، والاقتراح يريد تعديتها إلى العقوبة المالية، فهل هي جائزة؟ إن هذا الاقتراح لابد له من أن يجتاز أربع عقبات حتى يكتب له القبول في نظري، وهو ما لم يتعرض له الأستاذ الزرقاء في اقتراحه. هذا مع ملاحظة أن المدين المماطل قد يكون له كفيل فيطالب، أو رهن فينفّذ عليه.
