Property as an institutional basis for the formation of law

Abstract: The article considers conditioning the historical process of forming the law by the achieved level of development in property relations and their separation from the power, thus securing the sufficient subjectivity of individuals and the possibility of wide dissemination of the regulatory equivalence principle. It is demonstrated that the private property institution which casted itself in a stable form is not only the most important empirical marker of the phenomenon of law as such,but also the institutional basis on which other legal institutions are formed.
