Abstract: The European import banana market has been regulated through a Common Market Organization (ocmb) since 1993. Condemned by the World Trade Organization (mo) in 1997 after four Latin American countries and the United States complained, the European Union had to modify the ocmb for January 1999. But the new regime made immediately the object of a new complaint by the United States and Equator, and was condemned in April 1999 by the WTO, because some points of the new regulation did not conform with WTO conclusions in 1997. The article aims to precise the positions of the different actors during this last debate. Conclusions of the panel in 1999 and the last proposition of the ue are analyzed as well.
