SEPARATED RIGHTS IN REAL ESTATE

Abstract: Growing population and growing demand for land and related natural resources have resulted in an increasingly complex real property system. This report considers four kinds of separated rights: air, mineral, water, and transferrable development. In particular, the ways these rights are created, transferred, recorded, and valued (assessed) are examined. This report is part of a larger study in the Economic Research Service on the status and consequences of the structure of landownership in rural America.
