Abstract: It is a common fact that the Penal Codes of most states lack the norms regarding the notion and purposes of the criminal punishment. In fact, the penal legislation only determines the system of punishments, which can be named in case a certain crime is committed, this being the object of research of the penal law doctrine. At the same time, it is to be noticed that there is a great number of conceptions regarding the punishments, which are different depending on their contents: starting from the idea of reward according to the principle of retaliation, to the idea of resocialization of the felon.
