Dilapidations case update

Abstract:
The past few years have seen some helpful examples of dilapidations claims in practice and how the court will approach such cases. In addition to reviewing those, this paper will also outline some interesting developments in Scottish case law in relation to liquidated damages clauses. These developments may indicate the potential for change in how dilapidations claims are dealt with in England and Wales if appropriate lease provisions are included at the relevant time.
