Abstract: The sentence of the European Court of Justice of 19 March 2019 annuls the European Commission’s decision on the Tercas case and rehabilitates the role of Fitd Consortium which will then be able to implement preventive and alternative measures facing depositors of ailing banks. This historic decision paves the way for various forms of resolution intervention or to facilitate aggregations, in particular between medium and small banks
