Abstract:
This contribution focuses on identifying the legal entity that embodies the role of "employer" and makes decisions regarding employees. The transformative dynamics brought about by the digital economy are driving changes in the role of the employer. There is a growing discrepancy between the role of the employer, as typically found in labor relations—as the owner of productive assets and able to operate autonomously—and the limited bargaining power of firms gravitating toward digital technology corporations. The approach will consider the impact of new technologies on labor relations, the advantages and risks of using artificial intelligence (AI) systems in the workplace, and how the use of algorithms can influence managerial decisions regarding employees.
