Abstract:
Association penalties are an important tool for establishing discipline within a society. On the occasion of a recent Federal Supreme Court decision, the article outlines the formal and substantive requirements of the case law on administrative penalties in the statutes of cooperatives. The antitrust prohibition of § 1 GWB and the legal status of cooperative immanence are of central importance.
