Abstract:
Against the background of the founding of community-oriented cooperatives, the article deals with the question of whether cooperatives in the German tradition can serve the "common weal" or a "community". A first analysis from a jurisprudential perspective shows that community-oriented cooperatives (third party promotion) are not legally permissible. A detailed economic analysis shows that such constructs can hardly be justified in terms of incentive theory. In practice, there is also the danger of the cooperative legal form being misused. This does not imply that cooperatives do not have a positive impact on a community. Rather, this is tobe expected. However, the promotion of the members must be the primary objective of a cooperative.
