Abstract:
The article whose title would translate into "Tendencies in cooperative law - worldwide" concentrates on the tendency to translate the recognized cooperative principles into law and asks whether legislators have a legal obligation to do so. According to public international law, they have. The distinction of cooperatives from other enterprise types and the capacity of cooperatives to contribute to the pursuit of the legal concept of sustainable development require bundling the cooperative principles into one principle, that of an all permeating member participation and control. Its translation into law meets difficulties as cooperatives have developed into complex structures and are de-organizing through their integration into value chains and networks. At the end the article raises the question of whether cooperative law can only be conceived as an organizational law, or also as a law that institutionalizes the idea of cooperatives without organizing it.
