Abstract: Marine oil transportation has a poor performance record in terms of safety. Indeed, international regulation and system of liability and compensation for oil pollution damage do not provide sufficiently strong incentives for key actors in the sector to reduce their risky behaviours. We here investigate whether a civil liability rule could be an efficient tool for the prevention of oil pollution by inducing private actors to minimize oil pollution risk while ensuring a fair compensation for potential victims.
