L’instauration de droits de propriété sur les données personnelles: une légitimité économique contestable

Abstract:
?Personal data have become a major focal point for industries involved in the digital economy. ? Platforms operating their business model in a multi-sided market try to collect, process, and create value from these data, in order to improve their profits and market power. Therefore, property rights for users have been suggested as a way of improving both privacy protection and value sharing among users and industries. However, an analysis from a ?law and economics? perspective, looking in particular at the economic sources of property rights, allows us to reconsider this idea and to call for other ways of achieving economic development while respecting users? privacy.
