L'économie du droit entre révolution cognitive et tournant réaliste

Abstract: Law and economics is nowadays one of the main fields in economic theory. However, the key aspect of contemporary law and economics is its methodological and theoretical pluralism. The article focuses on this feature and tries to explain the deep reasons of this pluralism. First of all, we show that law and economics is the heir of two main controversies in economic and in legal theory: the one about information in economics and the one about interpretative practices in law. Then it is possible to characterize the different schools of thought in law and economics by showing how information and interpretation are linked. The stakes of the paper are to show how the different schools use different representations of the nature of the legal norms.
