L’influence de la recherche en gestion sur la qualification juridique du stress

Abstract:
Even though a significant number of papers dealing with stress exists within the literature, few of them focus on the link between management and the law. Given that lawyers and managers use common terms with different, domain-specific interpretations, this paper explores how stress is framed in management and law. First, we explore the potential influence of these two disciplines on each other regarding stress management. Second, we investigate legal indicators of work-related stress. Results highlight the liabilities associated with the framing of work-related stress and the risks incurred by managers and employers, which are deepened by the relationship and interaction between law and management.
