Abstract:
Natural property and the ecosystem services that it supplies are nowadays the subject of diverse valuations. The aim of this article is to examine whether these valuations have consequences for the classical qualifications of such property and services. Based on the main distinctions and categories of property law, the conclusion is that the various implemented forms of valuation have no impact on the applicable qualification, but that the positioning, even indirectly, of such property and services in a system of exchange?and all the more so in a market system?leads to the fringes of ?commodification? and justifies the implementation of independent regulation.
