Abstract:
European consumer law is well established. The Juncker Commission sought to update the existing body of law to make it fit for the new challenges. But is this really the case ? The two new challenges of our times?digitalization and sustainable development/climate change?require a serious stocktaking of the state of affairs. It turns out that consumer law is closely intertwined with the ideology of growth. A sustainable consumer law will have to look different, and the author doubts whether technology?the digitalization of the economy and society?will be the solution. This paper is an invitation to tackle these issues upfront and to choose a dangerous method (C. Jung) : rethinking consumer law from scratch.
