Abstract:
Is immunity from execution called into question by fundamental rights? Because both the International Court of Justice and the European Court of Human Rights consider that immunity from execution does not violate fundamental rights, its impact is in principle limited. Areas of resistance appear to be all the more marginal in that, although some national courts have dissented from international case law, their positions have been strongly sanctioned. With a view to future developments, they are nevertheless worth exploring.
