Abstract:
The debtor?s bank assets, usually the preferred target of creditors with an enforceable title, present important specificities when they are held by a State or one of its entities or emanations. An analysis of the various regimes governing bank assets reveals that, in practice, it is often impossible or very difficult for state creditors to successfully circumvent the formidable obstacle of state immunity from measures of constraint, due to the existence of specific immunity regimes for certain bank assets and to the evidentiary difficulties that creditors may encounter.
