Immunité d’exécution des États et créances salariales

Abstract:
Both employees and wage claims have a special place in international law. While the immunity of States from jurisdiction is limited, the same cannot be said for immunity from execution. Is the denial of justice resulting from immunity from execution, with an order for damages remaining unaccounted for, acceptable? Two approaches are explored to remedy the situation: that of a possible convergence of analysis between immunity from jurisdiction and immunity from execution regarding certain employment disputes, and that of a reconciliation of immunity from execution and the interests of the employee by engaging the strict liability of the forum State.
