Les conditions de la renonciation à l’immunité d’exécution de l’État en droit français

Abstract:
The conditions for renunciation the State?s immunity from execution have given rise to particularly fluctuating solutions in French law in recent years. After much hesitation in the case law, the French Cour de cassation now considers that when the assets of a State are not specifically used or intended to be used in the exercise of diplomatic or consular missions, the express renunciation by that State of immunity from execution is sufficient for the assets in question to be the subject of an execution measure, regardless of whether they consisted of tax claims, without any special renunciation being required.
