Un exemple d’ouverture formelle à la transversalité: le droit des sociétés

Irina Parachkevova-Racine

Revue internationale de droit économique, 2023, vol. t.XXXVII, issue 2, 37-47

Abstract: There have always been multiple ways to teach corporate law. The choice itself deeply questions one's vision of legal studies. This difference in teaching approach is not new. What is, however, very new is the significant normative shift that corporate law has undergone within the framework of the ecological transition. Among all the legal fields within the realm of economic activities, corporate law has probably been the most heavily influenced by environmental concerns in recent years. Another novelty is also changing the landscape: students are the generational pillar of public opinion, which now places new expectations on companies. There is no doubt that this presents potential for the renewal of corporate law studies. The question is how this potential can be harnessed. Clearly, the answer fundamentally depends on the teacher themselves, and the challenges are quite significant. At the same time, this ecological focus provides fertile ground for the teaching of economic law in the sense of a school of thought, capable of breaking down field boundaries and approaching it from a broader perspective, thus fostering the necessary creativity to navigate it effectively.
