Abstract: In this paper it is highlighted the complexity of Franchise that is rightly considered a very attractive opportunity for the owner of a business who wants to expand as well as for future entrepreneurs which plans to open a business. In this pattern of approach for a business owner franchise is the perfect way to enter in other markets and at the same time an alternative to the costly solution of setting up new economic entities. Also, for those who want to launch in businessfranchise is is the best way to achieve its goal involving considerably lower risks and with great chances of success. Another important aspect presented in this scientific research refers to the negotiation precessof franchise agreementfrom which results that most of contractual clauses are stipulated and inserted by the franchisor to maintain the stability of the franchise system. At the same time it is underlined the idea that the franchise agreement is designed and formulated by the franchisor, in order to protect its interests and the created business. Simultaneously with highlighting the characteristics that define the franchising as a modern economic phenomenon, is shown the overall evolution of the franchise market in Romania from the economic and legal perspective.
