Abstract: This paper expounds the SMEs' concerns regarding the innovation activity and the inventions protection by means of the patent. Furthermore, there are shortly described the main problems the small and medium enterprises have to deal with, problems concerning the obstacles that may appear at the patent laying down and at the exclusive royalties taking over.
