Abstract: The “Empresa de inserción social” (Social Insertion Enterprise) has become a new tool for socioeconomic organisation within the general framework of enterprises providing social insertion through economy. This kind of enterprise is meant to be an efficient entrepreneurial instrument provided by Social Economy in order to tackle the problems posed by unemployment. This brand new approach combines entrepreneurial working methods with the objectives of social insertion and has proved to be successful in several EU countries, such as Italy, Belgium and France. Therefore, it is expected to have a specific legal status in Spain soon. This article analyses the legal problems arising from this new model which conceives the economic structure of an enterprise as a means to insert certain groups both into society and the labour market.
