Abstract: Si bien nuestro sistema de salud tiene muchas ventajas, también presenta diversos problemas. Esto se puede confirmar en la gran cantidad de tutelas en salud que se presentan cada ano, pues su profusa interposición muestra que los usuarios deben recurrir a una acción judicial en procura de una atención completa. Ahora, los elevados costos de los medicamentos en el territorio nacional dificultan su entrega oportuna por parte de las entidades promotoras de salud (EPS) y pueden ser causantes de la interposición de tutelas por solicitud de medicamentos. Dentro de este marco, esta investigación rastrea cuál es el impacto que ha tenido la regulación de precios de medicamentos en el número de tutelas que se presentan por vulneración al derecho a la salud. Para hacerlo rastrea cuáles son las causas que motivan la interposición de tutelas por medicamentos. Como resultado, la investigación muestra que, presuntamente, la regulación que existe desde el 2016 ha tenido un impacto en el número de tutelas que se presentan por asuntos relacionados con medicamentos y que la interposición de tutelas por solicitud de medicamentos responde a una variedad de causas, no solo a omisiones regulatorias, que involucran a diversos actores del sistema de salud como el Estado, las EPS, las farmacéuticas, los pacientes y las prestadoras del servicio de salud. ***** Although our health system has many advantages, it also presents several problems. The large number of health tutelas that are filed every year, as their profuse filing shows that users must resort to legal action in order to obtain complete care, can confirm this. Now, the high costs of medicines in the national territory make it difficult for the health promoting entities (EPS) to deliver them in a timely manner, which may be the cause of the filing of tutelas for requesting medicines. Within this framework, this research traces the impact that the regulation of drug prices has had on the number of tutelas filed for violation of the right to health. To do so, it also tracks the causes that motivate the filing of tutelas for medicines. For this purpose, the existing regulation is analyzed, using the method of differences in differences and semi-structured interviews are conducted with different actors of the health system. As a result, the research shows that, presumably, the regulation that has existed since 2016 has had an impact on the number of tutelas filed for matters related to medicines and that the filing of tutelas for medicine requests responds to a variety of causes, not only to regulatory omissions; which involve various actors in the health system such as the State, EPS, pharmaceutical companies, patients and health service providers.
