Abstract:
This paper provides a historical and comparative overview of the conceptual origin of “public services” and its evolution in Europe. It recalls the French origin of a public service doctrine popularized under the Third Republic (section 1), which then spread to the European States subject to French law. Far from making consensus in Europe, this definition of public services can be put into perspective with the different national conceptions of public services in Europe (section 2). Such a comparison can notably be based on two types of criteria: the nature of the activity covered by the public service (section 3) and the form of organization of the service. Within this last criterion, responsibility for legal and organizational matters is dealt with in section 4.
