Abstract: This research addresses the violation of the right to defense in prenatal maintenance proceedings due to procedural disloyalty, such as bad faith or malice on the part of the mother in delaying the summons to the alleged father. This affects her ability to respond, while a provisional pension is fixed and generates debt before his appearance. The objective is to analyze this impact and propose strategies that guarantee the balance of rights between the parties. With a descriptive non-experimental design, supported by surveys and the inductive-deductive method, the need to regulate reasonable deadlines for the summons was identified, guaranteeing a fair and equitable defense in these processes
