LA DÉMOCRATIE DANS LA RÉALITÉ CONSTITUTIONNELLE CONTEMPORAINE

Abstract: In its classical, scholastic sense, democracy is perceived as an assertion of the will of a given majority. In the present day, democracy represents the exercise of power by the people in a world dominated by the representative system. The realities of the contemporary society require the existence of a representative assembly and related to this a important role has the electoral system, who refers to the stipulations pertaining to the exertion of the civic voting right, whereby a citizen is either called upon to appoint the parliamentarians, or is canvassed for his opinion about (as well as his approval of) a specific project or an agenda. The vote can be more or less comprehensive and it can also be exercised in different ways. Romania is still looking for the appropriate method to designate the representatives, starting from a party-list proportional representation system, moving on to a plurality voting system (the „uninominal“vote) and back to the proportional representation system.
