THE PRINCIPLE OF PARTY DISPOSITION IN CIVIL LAWSUITS

Abstract:
One of the main principles of civil procedural law is the principle of party disposition, which is the subject of the present article, with the procedure and its effects. The principle is not an absolute one, there are some legal limitations. We have to mention that in the Romanian civil procedure party disposition is not absolute given that the protection of certain persons or interests has also been recognised as active procedural legitimisation for other persons or organs besides the holder of a right.
