Abstract: •Re-utilization of extractive waste has the potential to help meet the future demand of critical raw materials.•The EU legal framework can be considered underdeveloped in relation to re-utilization of extractive waste.•The preconditions for secondary extraction in the EU are not sufficiently clear to contribute to higher recovery rates.•A shortcoming of the EU legal framework is the interface between waste, extractive waste and non-waste.
