Abstract:
The present paper analyses the EU regulation in the Trans-European Network (TEN) sector and the national matters put forward. We will first of all analyse the late incorporation of the TEN development predictions in the Community Treaties and the legal regulation characteristics. This regulation suggests the following questions: the configuration of a shared policy between the EU and the Member states, the restriction of the intervention community means to encourage the TEN development and the peculiarity of the decision procedure in this field. The characteristics of the community assistance for the TEN development are also object of study, as well as the problems caused by the public interventions in each of both fields in which the EU has the right to intervene in the TEN development: transport and energy.
