The battle against digital copyright infringements in ASEAN

Abstract: Globally, an estimated 95 percent of music downloads are unlicensed and illegal, according to representatives from the International Federation of the Phonographic Industry. In addition to music downloads, there has also been a constant increase in the illegal downloads of films, computer games, and other software. A number of ASEAN countries have, in recent years, been featured as having the highest rate of illegal software downloads, according to reports by the Business Software Alliance (BSA), a software industry group with presence in many jurisdictions. Two such ASEAN member countries are Thailand and Indonesia. Further, in the United States Trade Representative’s Special 301 Reports, these ASEAN member countries were placed on either the “Priority Watch List”, or the “Watch List”. This chapter focuses on these two countries to understand the legal and societal landscape in relation to digital copyright law and infringements.
