Sustainability and uncertainty in governing European employment law – the community method as instrument of governance: The case of the EU Working Time Directive

Abstract: The chapter contains a comparative account of the EU Working Time Directive (WTD) and its implementation in four member states. The history of and attempts to reform the WTD are introduced in order to analyse the community method as an instrument of governance in the EU. The main finding of the chapter is that failed attempts at the supranational level in reforming the WTD and ideological resistance at member state level have created legal and political uncertainty and have undermined sustainability in governing European employment law.
