The role of the legal adviser in an inclusive, networked multilateralism

Abstract: The chapter provides insights into the role of the Office of Legal Affairs of the UN Secretariat (OLA). Beyond its core legal advisory and services roles, OLA plays a crucial role promoting and facilitating cooperation across the varied legal offices and services of the UN system. The chapter highlights the dynamism which characterizes relationships between UN legal advisers, as they work across diverse topic areas, identifying legal issues of common concern and areas for cooperation. A brief history of UN legal cooperation is offered, and contemporary methods are clarified. The three UN legal advisers’ networks facilitate discussions about common interests and the sharing of information, with the effect of improving communication and promoting system-wide legal coherence. Finally, the chapter clarifies advisers’ ever-present tasks, including advice, guidance, and litigation on privileges and immunities; contemplates the legal coordination of peace missions; details contemporary issues confronting advisers (namely COVID, MEDEVAC, GDPR issues); and considers the UN approach to sexual harassment. Such issues challenge UN lawyers but also illustrate the levels of coordination and cooperation they exhibit.
