Chapter Article 15 in The UNCITRAL Model Laws on Cross-Border Insolvency and on the Recognition and Enforcement of Insolvency-Related Judgments, 2025, pp 135-150 from Edward Elgar Publishing
Abstract:
Article 15 sets forth the requirements for the application for recognition. The requirements are minimal in order to facilitate prompt recognition and relief. The status of the foreign proceeding and the foreign representative can be shown by including certified copies of the relevant court orders, a certificate from the foreign court, or other documents. In order to facilitate the recognition process those documents do not have to be legalized.
