Abstract:
This chapter deals with the Financial Collateral Directive. It will argue that its qualification as ‘property law’ is dubious. Rather, it is a Directive that requires certain contractual arrangements (collateral arrangements) to be enforceable in accordance with their terms. Viewing the Directive in this perspective may have a positive effect in establishing a truly universal legal regime for collateral arrangements in the EU.
