Chapter 5 in EU Digital Law, 2026, pp 333-411 from Edward Elgar Publishing

Abstract: The most valuable assets in the digital economy are intangible assets. The EU legal framework providing protection to those assets is discussed. The respective roles of patents, trade secrets and design rights in protecting innovation and the evolution of the EU legal framework to address the challenges posed by disruptive digital technologies are presented. The issues raised by the use of trademarks in electronic commerce, including the coexistence of trademarks on the Internet, online advertising, sales through platforms and exhaustion of rights, receive particular attention. This chapter also details the interplay between trademarks and domain names and the rules on ‘.eu’ domain names. Finally, enforcement issues are also discussed.
