Abstract:
This chapter examines copyright protection in digital environments. After introducing the international and EU legal framework, it begins by exploring the means available for the protection of computer programs and databases. As regards the exclusive rights granted for the protection of works and other subject matter, the scope of the reproduction right, communication to the public, distribution right and rental right with regard to digital activities are discussed in the light of the significant body of case law of the CJEU. The specific rules on online content-sharing platforms, online uses of press publications, and fair remuneration in exploitation contracts are also analysed. Particular attention is devoted to the relevant exceptions and limitations, including those on text and data mining and their significance for AI tools, as well as to the protection of technological measures and issues of enforcement.
